ELIZABETTA TERMS OF USE

Effective Date: October 21, 2026

These Terms of Use (“Terms”) govern access to and use of https://www.elizabetta.net (the “Site”), including its online shopping features. The Terms are intended to apply to the Site generally. United States transactions: For Site use and transactions offered to customers in the United States, these Terms apply alongside applicable federal and state law. Nothing in these Terms limits rights that cannot lawfully be waived.

“Elizabetta,” “we,” and “us” mean Elizabetta Boutique LLC, the operator of the Site and trading as Elizabetta. The address for privacy correspondence is Elizabeth Perkins, CDA Casali, 19, Carassai (AP), Italy. The seller for a specific order is the entity identified in the checkout and order confirmation.

1. Acceptance, Scope, and Changes

By accessing or using the Site, you agree to these Terms and the Privacy Policy published on the Site. If you do not agree, do not use the Site. These Terms apply to visitors, account holders, and customers. Product purchases may also be subject to order-specific terms, shipping, returns and refund information presented at checkout or in policies posted on the Site, and other checkout disclosures. Mandatory consumer rights that apply where you live are not waived by these Terms.

We may update these Terms by posting a revised version on the Site and changing the effective date. For material changes, we will provide notice or obtain renewed agreement where required by law. Changes will not retroactively alter a completed order or take away rights that cannot lawfully be limited.

2. Access and Eligibility

You may browse the Site without registering. You must provide accurate information when using account, checkout, or contact features and must be legally capable of entering into the relevant transaction. The Site is intended for users aged 18 or older. You may not use the Site for an unlawful purpose or in violation of these Terms.

3. Site Content and Intellectual Property

You may link to the Site, but you may not frame or replicate any page. A link must not imply our endorsement, misrepresent your relationship with us, or originate from a site you do not own or control. We may ask you to remove a link that is unlawful, misleading, infringing, or otherwise inappropriate.

The Site and its content, including text, data, audio, video, product descriptions, photographs, images, graphics, custom graphics, logos, button icons, designs, and the selection, compilation, and arrangement of that content, are owned by Elizabetta or its licensors and protected by U.S., international, and other applicable intellectual-property laws. We grant you a limited, revocable, non-exclusive, non-transferable permission to access and use the Site for personal, non-commercial browsing and shopping. No other right or license is granted. You may not copy, reproduce, distribute, transmit, republish, modify, publicly display, perform, create derivative works from, sell, or commercially exploit Site content by any means or process without our prior written permission. The absence of a trademark or service-mark symbol does not constitute a waiver of any rights in a product, feature, service name, or logo. Third-party marks and content remain the property of their owners.

4. User Conduct and Submissions

You must not: (a) violate applicable law or another person’s rights; (b) interfere with, damage, disable, overburden, or impair the Site, its security, or another user’s access to or enjoyment of the Site; (c) attempt unauthorized access to any portion of the Site or its content or services; (d) upload malware, computer viruses, Trojan horses, corrupted data, or other harmful code, software, or data; (e) scrape, crawl, harvest, or collect personal information through the Site without authorization; (f) submit material that is false, misleading, unlawful, abusive, obscene, pornographic, defamatory, discriminatory, intended to incite racial or other unlawful hatred, in breach of confidentiality, infringing, privacy-violating, or likely to encourage criminal conduct or give rise to civil liability; or (g) impersonate another person or misrepresent the source of a submission. We may remove content or suspend access where reasonably necessary to protect the Site, users, or our rights, subject to applicable law. We may preserve or disclose information, including information identifying a person who submitted material, when reasonably necessary to respond to valid legal process or lawful requests from government authorities, consistent with applicable law and our Privacy Policy.

If you send a review, comment, suggestion, or other submission, you represent that you have the rights and permissions needed to do so. You grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, display, and distribute that submission as reasonably necessary to operate, promote, and improve the Site and our products, subject to applicable law and our Privacy Policy. We may moderate or remove submissions but are not obligated to publish them. This section does not transfer ownership of your submission.

You must not use the Site while operating a motor vehicle or while otherwise distracted or preoccupied in circumstances where doing so could create a safety risk. Access and use the Site with due regard for your safety and the safety of others.

5. Products, Prices, and Availability

We make reasonable efforts to describe and depict products accurately, but colors and appearance may vary by device and display settings. Product descriptions, availability, and prices may change. Products may be limited in quantity and may be withdrawn from sale. We may limit quantities or decline orders where permitted by law, including where an order appears to be placed for resale or distribution. Any restriction will be applied consistently with mandatory consumer law.

The Site may contain errors or omissions, including in descriptions, prices, promotions, shipping charges, delivery estimates, or availability. We may correct an error and, where legally permitted, cancel an affected order. If payment has been taken for an order we cancel, we will arrange a refund using the original payment method or as otherwise required by law. We will notify you using the contact details provided with the order.

6. Orders and Payment

Placing an order is an offer to purchase the selected products. The order is accepted when we send an order-acceptance confirmation. An automated receipt confirming submission is not acceptance unless checkout expressly states otherwise. We may decline an order before acceptance and will communicate material changes or cancellations using the contact details provided.

You must provide complete and accurate billing, delivery, and contact information and keep it current. Payment methods, currency, applicable taxes, payment authorization and capture timing, and payment provider are displayed at checkout.

7. Shipping, Delivery, and Returns

Available delivery destinations, delivery charges, carriers, processing times, and estimated delivery windows will be shown at checkout and, where applicable, in shipping information posted on the Site. Delivery estimates are not guarantees unless expressly stated. Import duties, customs charges, and local taxes, if applicable, are described at checkout or in the applicable shipping information.

Returns, exchanges, cancellations, and refunds are governed by the applicable information presented at checkout and any Returns and Refunds Policy posted on the Site, subject always to mandatory statutory rights.

8. SMS Terms

If the SMS program is offered, participation is optional and is not required to make a purchase. By voluntarily providing a telephone number and giving any consent requested at the point of collection, you agree that an Elizabetta representative may contact you at that number, including through calls or text messages using automated technology or a prerecorded message, as described when you provide consent. You may opt out of SMS messages by texting STOP to +1 (833) 942-3631 and request assistance by texting HELP to that number or emailing support@elizabetta.net. Message frequency varies and message/data rates may apply. SMS program details are provided at enrollment.

9. EEA and UK Consumer Terms

For consumers in the EEA or UK, these Terms are subject to mandatory consumer-protection laws that apply in the consumer’s country of residence. Nothing in the Terms excludes or restricts any non-waivable right, including any applicable right to withdraw from a distance purchase, obtain a remedy for non-conforming goods, or bring a claim before a competent court. Applicable withdrawal periods, exceptions, return procedures, delivery terms, and seller identity are provided in the checkout disclosures and in applicable policies posted on the Site.

If you are a consumer habitually resident in the EEA or UK, a choice of law in these Terms will not deprive you of protection afforded by mandatory provisions of the law of your country of residence where those provisions apply. The forum provisions below do not restrict a consumer’s right to bring proceedings before a court with jurisdiction under applicable law.

10. Privacy and Cookies

Our collection and use of personal information are described in the Privacy Policy published on the Site. Cookie and similar-technology choices are made through the Site’s cookie preference controls, where available. Use of the Site does not itself signify consent to optional cookies or marketing where separate consent is required.

11. Third-Party Tools and Links

The Site may include links, tools, apps, advertising, or content supplied by third parties. Those third parties operate under their own terms and privacy notices. We do not control third-party services and are not responsible for their content, availability, transmissions, advertising, links, changes, updates, or practices, except to the extent liability cannot lawfully be excluded. A link is provided for convenience and does not imply our endorsement. Your use of an external link or third-party website is at your own risk and subject to the third party's applicable terms and privacy notice.

11A. Chatbots and Generative AI. If the Site offers a chatbot or other feature powered by generative artificial intelligence (an “AI Feature”), the AI Feature is provided for general informational purposes. AI-generated outputs may be incorrect, incomplete, misleading, offensive, or unsuitable for your inquiry. You should use your own judgment and, where appropriate, verify outputs using reliable sources. Do not rely on an AI-generated output as the sole basis for an important decision. You are responsible for how you use AI-generated outputs and for decisions, actions, or communications based on them. Do not submit personal information that you do not want processed through the AI Feature. Our collection and use of information through an AI Feature are governed by our Privacy Policy. An AI Feature may use third-party technologies or services and may experience errors, interruptions, or limitations outside our reasonable control. The disclaimers and limitations of liability in these Terms apply to any AI Feature to the maximum extent permitted by law.

12. Site Availability and Disclaimers

We may maintain, update, suspend, or modify the Site and may make improvements or changes to products, services, descriptions, or other Site content at any time. Where reasonably practicable, we will provide advance notice of planned maintenance that may materially limit access to the Site. We do not guarantee uninterrupted or error-free availability or that the Site or its content will be free from defects, viruses, or other harmful code. You should use appropriate security protections, scan for viruses where appropriate, and maintain current backups for your device and data. Site descriptions, documents, graphics, and general information are provided for informational and shopping purposes and may contain technical inaccuracies, typographical errors, or other errors, or may become outdated. Except as expressly stated and to the maximum extent permitted by law, the Site is provided “as is” and “as available,” without representations, endorsements, or warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, completeness, correctness, reliability, timeliness, usefulness, or availability. These disclaimers concern the Site and general Site information and do not exclude or limit any mandatory statutory product-conformity right, warranty, consumer remedy, or other liability that cannot lawfully be excluded or limited.

13. Liability

Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited by applicable law, including liability that cannot be excluded for consumers. Subject to that limitation, and to the maximum extent permitted by law, we are not liable for indirect, incidental, consequential, special, exemplary, or punitive loss or damages that were not reasonably foreseeable, including loss arising from use of or inability to use the Site, reliance on Site information, mistakes, omissions, interruptions, deletion of data, transmission failures, or other failures of performance. We are also not liable for loss arising from use of the Site for a purpose other than ordinary personal browsing or shopping. Where permitted by law, you are responsible for reasonable costs of servicing, repairing, or replacing equipment or data resulting from your use of the Site.

14. Indemnity

To the extent permitted by law, you will defend, indemnify, and hold harmless Elizabetta and its officers, directors, employees, agents, licensors, and suppliers from third-party claims, liabilities, settlements, and reasonable legal and accounting costs directly caused by your unlawful use of or access to the Site, infringement of third-party rights, or material breach of these Terms. This provision does not impose liability on a consumer beyond what applicable law permits.

15. Suspension and Termination

You may stop using the Site at any time. We may suspend or restrict access where reasonably necessary for security, legal compliance, fraud prevention, or a material breach of these Terms. Suspension or termination of Site access does not cancel obligations or remedies relating to an accepted order, and does not affect rights that accrued before termination.

16. General

If any provision is held unenforceable, the remaining provisions continue to apply to the extent permitted by law. A failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them as part of a reorganization or transfer of the relevant business, subject to applicable law. The Site and its content may be subject to U.S. export-control laws and the export or import laws of other countries. You must comply with applicable trade-control laws and obtain any authorization required to export, re-export, or import Site data or content. These Terms, the Privacy Policy, and any policies expressly incorporated into them form the agreement concerning Site use, without displacing mandatory consumer rights or order-specific terms.

17. Governing Law and Disputes

Except as provided in Section 17A, these Terms do not select an exclusive governing law or court venue. Applicable law and the courts with jurisdiction are determined by the laws governing the transaction and any mandatory rules that apply, including consumer-protection rules in your place of residence. Nothing in these Terms, including Section 17A, limits a consumer’s right to bring proceedings before a competent court where that right cannot lawfully be waived.

To the extent permitted by applicable law, any claim arising out of or relating to the Site must be commenced within one year after the claim accrues; otherwise, the claim is permanently barred. This one-year period does not apply where a longer period cannot lawfully be shortened by agreement.

17A. Arbitration and Class Action Waiver Please read this Section 17A carefully. It affects how certain disputes are resolved. Except where prohibited by applicable law or excluded below, any dispute, claim, or controversy arising out of or relating to these Terms, the Privacy Policy, the Site, or the breach, termination, enforcement, interpretation, or validity of these Terms, including any dispute about the scope or applicability of this Section 17A, will be resolved by binding arbitration before one arbitrator. The arbitration will be administered by JAMS under its Streamlined Arbitration Rules and Procedures and, where applicable, the JAMS Consumer Arbitration Minimum Standards. The arbitrator will decide all issues, including issues concerning arbitrability, except that a court of competent jurisdiction will decide any issue concerning the enforceability of the class-action waiver below. The arbitration will be conducted in English. At your election, it may be conducted by video conference, telephone, written submissions, or an in-person hearing at a reasonably convenient location, subject to the applicable JAMS rules. Elizabetta will pay the arbitrator’s fees and JAMS administrative fees to the extent required by the applicable JAMS rules or law. Each party will otherwise bear its own attorneys’ fees and costs unless the arbitrator awards them under applicable law. Judgment on an arbitration award may be entered in any court having jurisdiction. Either party may seek provisional remedies in aid of arbitration from a court of competent jurisdiction. Either party may also bring an individual claim in small-claims court if the claim qualifies and remains in that court. Nothing in this Section 17A prevents either party from exercising lawful self-help remedies or seeking relief that cannot lawfully be restricted to arbitration. Where applicable law permits a claim for public injunctive relief, the arbitrator will decide the merits of that claim, but a prevailing claimant may ask a court of competent jurisdiction to enter any public injunction authorized by the award. TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AND ELIZABETTA AGREE THAT EACH MAY BRING A DISPUTE ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF, CLAIMANT, REPRESENTATIVE, OR MEMBER IN A CLASS, COLLECTIVE, CONSOLIDATED, REPRESENTATIVE, PRIVATE-ATTORNEY-GENERAL, OR PUBLIC-INTEREST PROCEEDING. Unless both parties agree otherwise, the arbitrator may not combine the claims of more than one person or preside over any form of representative or class proceeding. You may opt out of this Section 17A by emailing support@elizabetta.net within 30 days after you first accept these Terms. Your notice must include your name, the email address associated with your account or order, if any, and a clear statement that you opt out of arbitration. Opting out will not affect your ability to use the Site or make a purchase. If any part of this Section 17A is held unlawful or unenforceable, that part will be severed and the remainder will remain effective to the fullest extent permitted by law. If the class-action waiver is held unenforceable as to a particular claim or requested remedy, that claim or remedy will proceed in a court of competent jurisdiction after all arbitrable claims and remedies have been resolved. This Section 17A does not apply to a consumer habitually resident in the EEA or UK to the extent a pre-dispute arbitration agreement would restrict the consumer’s right to bring proceedings before a competent court. It also does not waive any other right or remedy that cannot lawfully be waived.
